[WSBAPT] Dismissal

I have a pleading question which is in the event that answer has been filed but no counterclaim and plaintiff wishes to dismiss that answering defendant does notice of motion and order of dismissal have to be given to other counsel prior to entry of order of dismissal even if atty fees were requested. Under civil rule 41 it is mandatory under the rule if done before resting and no counterclaim filed. Thank you
