[WSBAPT] unfiled unlawful detainer

At minimum, you need to serve the attorney with a notice of appearance;
better yet, timely serve an answer.  It is common practice to serve an
unfiled UDA and if no timely response is served, they simply file the case
and get an immediate default/default judgment and writ of restitution.

Subject: [WSBAPT] unfiled unlawful detainer

 

Current client, long time friend, has been 'served' by posting of unlawful
detainer action in commercial case.  The case is unfiled, per Odyssey.  Does
that mean he does not need to reply yet?  I am unsure if unlawful detainer
can be filed last minute before hearing and still be effective?
