I hope others with more experience will chime in but it has been my experience that transfer agents for shares of stock require letters.  When I have pointed out that WA law states that the shares transfer by operation of law, they have responded that the shares and the transfer agents are guided by federal law, not state law.  In my case, the shares were in H's name only.  It may different if both names are on the stock certificate.

Can you use a Small Estate Affidavit where the spouse is transferring title to stock? The stock already belongs to the spouse by operation of law, but it needs to be re-registered in the surviving spouse's name. The value of the account is $300,000. Can we claim a transfer amount of zero by operation of law or must it be $150,000 as half of the community property?
