Let KeyBank know you will be requesting the court to order KeyBank to pay your client’s fees to get something that is not legally necessary – only necessary to satisfy their internal policy. They may change their tune.

Not knowing the answer but tossing the idea out -

is it possible to still log into the social security portal to get a screen grab/print showing the name? Otherwise, I agree with Diane that getting a simple ex-parte order saying Susan Smith is really Rebecca Susan Smith and ordering Key Bank to stop being jerks and transfer the money.

Yes - I am that petty, I look for slight and subtle ways for the Court order to point out how ridiculous they are....all within the bounds of the RPC's and applicable laws, of course.

This is one of those things that drives me nuts about our laws - they are toothless to people/entities that fail to follow them which requires the individual and their attorney to waste time and money even though the law is on your side.

Good luck to you!!

Sadly
Despite common sense, Key bank will likely only accept a court order.

I would think you could get it ex parte with a declaration from surviving spouse as to facts of names belonging to one person

My client is PR of an estate of his wife. One asset is an IRA at KeyBank in decedent’s middle and last name only. Not uncommonly, decedent generally went by her middle and last name. When she invested $$ in this IRA she used her Middle and Last Name. Surviving Spouse is the beneficiary. KeyBank asked for a copy of her Social Security card because the death certificate has first middle and last name (which would match the death certificate). No social security card exists and social security won’t issue a new one to a dead person. Bank insists on a copy of a social security card I guess so that they can see all 3 names of decedent, notwithstanding they have a death certificate and letters testamentary, each of which has all 3 names.
Suggestions?
