First, I would look to the statute and see if attorneys fees and coats are allowed, here it was ejectment Action. Then if the PR has non intervention powers, I would certainly take the additional costs relative to one heirs actions into consideration when we close estate and provide distributions. The heir can object within thirty days and if not, distribute as proposed by PR.

Is there any authority that allows a PR to assess direct costs to a beneficiary who has created the cost from that beneficiary’s distributive share or do you need to get court permission?
