Yes, eventually, but I had to do the contacts because they don’t ever seem to take clients seriously or clients don’t know how to effectively communicate the legalese. It’s never easy to get to anyone of authority who can or is willing to do anything about it. And, there is a lot of groveling involved. They have to file the notice of continuation of the sale, which is in writing making the postponement official. I doubt you will get an outright discontinuation of the sale, but only a postponement to buy time to get it closed.

These were regular lender loans and not reverse mortgages, so I don’t know if that makes a difference.



Property in Seattle is a hot commodity these days. The price might get bid up at auction and then you can go in afterwards and claim the excess proceeds.  I would have someone on the estate’s behalf attend the auction.



There are also those companies that will come in and “help” the one being foreclosed. They want the property and don’t want to compete for it on the courthouse steps or do an eviction afterwards, so they will pay to stave off the foreclosure and then work out a deal on its purchase. I’ve had clients do that as well, but I don’t have a name off hand. I believe these places saw the notice of trustees sale posting and then directly contacted the client.

Mike,

I don’t know the answer to your question about a foreclosure moratorium, but I have had a few of these over the years pre-pandemic where I have successfully gotten the lender to delay the trustee’s sale. It is easiest where you have a P & S signed and are heading for the closing. Sometimes just having it listed with a reputable realtor is enough. The key is working your way up the food chain of authority to get to a decision maker, and then kissing a lot of A**.
