Harkiran,
As quickly as possible identify as many institutions where the decedent may have held accounts and send the PR in there to give actual notice to the financial institutions that the errant heir is not entitled under a small estate affidavit. The PR’s Letters and a copy of the Order appointing to show to the institution will straighten out their thinking of who is in charge.
You will be able to go after the errant heir to get a court order requiring him to give the $$ to the PR, but if he is a deadbeat, as a practical matter the $$ could be gone, so stopping it beforehand would be the best.
If you can get a hold of him, call and give him a good chewing out and let him know you’re coming for him! Follow it up with a cease and desist letter.

Hi Listmates,

In a probate where there is a valid will and PR was issued letters testamentary, PR is now having trouble transferring any assets to the estate account because a disinherited adult child of the decedent is going around w/ a small estate affidavit.

What's the best first step here to respond?
