Couldn’t you address that in the NJDRA and have the non-heir sign the agreement?

We are nearing the end of an intestate probate in which one of the heirs disclosed that she is not actually a legal sibling of decedent, as their mom gave her up for adoption shortly after her birth. We had included her as an heir throughout the probate process with the understanding that she was an heir, but she is not.

What do we need to file with the court to get her removed as an heir? We are drafting a binding non-judicial TEDRA as the last step of the probate to transfer a house to our client from her decedent's husbands name, so wondering if we can just file a declaration from her at the same time, having her attest that she is not an heir of the estate.
