Hi Julie,
That is interesting as I have not heard that would be permissible if the trust was not in the will. There are Anderson v. Dussault implications (e.g. Minor’s due process rights), especially if the trust extends past age 18. I would be happy to consult on the situation to understand better why the GAL is recommending a settlement trust. I have drafted Minor Settlement Trusts for tort cases. Other frequent drafters would be Brothers & Henderson or Isenhour & Bleck.

I have a probate where the GAL is recommending a minor's inheritance be funded into a trust in compliance with SPR. We would like to have a recommendation to provide the court at the hearing. Any recommendations for an attorney that would fit this description? Self-referrals welcome.
