[WSBAPT] Tax attorney for Trustee

South King County CPA seeking referral:

I had a call yesterday from a trustee.  There is some question as to whether prior years returns have been filed.  In addition they may be Tax Treaty questions about filing in a foreign county.

You can appoint a custodian for the minor to hold title to the property.  I did this when a grandfather died and left property to his two minor grandchildren in his Will.  The court allowed the custodian to be appointed under RCW 11.114.030.  I'll send you my docs for example if you send me a personal email.  Back before COVID, we were asked by the Commissioner to come in person to a hearing.  I learned to give more information in my Petition regarding the father (married, how long, other children, relationship and who the kids were, their intent for the property in the future if any, etc.) and did a Declaration of the proposed custodian as C. Judson wanted to get to know the father so I brought him in person to the hearing.  Now, probably can send ex parte and if hearing is ordered, appear by Zoom.

Subject: [WSBAPT] Transfer on death deeds

This may be a simple real estate question: If a transfer on death deed names a minor as the transferee, what happens if the minor is still under 18 when the owner dies?  I see nothing in the statute (RCW 64.80) that addresses this question.  What could the negative consequences be?
