Yes, I am thinking I’ll file Summons and TEDRA petition as a separate action to object to reasonableness of fees within the 30 days. More cost to the client but safest option- Shannon

I assume you would conclude to follow the new statute since the worst that happens is the PR somehow objects to “your” hearing date and wishes to set “his or her own” hearing date? Which surely would be laughed out of the clerk’s office or courtroom, as the case may be . . . ? 😉

I just don’t like leaving anything in someone else’s control, so I’d do it all myself, for whatever it’s worth.

Okay, posting to everyone as this is my understanding. At page 77 of SB 5132, sections effective 7/25/21 includes Sec 4014 where you’ll find the new “Notice of Filing Decl of Completion Form” (pg 87-88 of SB 5132) modifying existing statutory form to include TEDRA Summons and Petition requirement and replaces the language of the old Notice form (which was what my client received prior to July 25th) - Shannon

Listmates, Client was served with Notice of Filing Decl of Completion 7/15, which was form saying she could petition the court re: reasonableness of fees within 30 days and, if she so petitioned, the estate attorney will request the court fix a time and place for hearing on her petition and notify her 10 days before the hearing. Effective 7/25, we have the new the changes to our statutes and the new form Notice which says she should petition the court under RCW 11.96A which I believe requires we file a separate TEDRA Summons and Petition and set our own hearing 20 days out. My client wants me to object to the reasonable of fees. Do I file a separate TEDRA Summons and Petition? Shannon
