Good Afternoon -

I had a call with the following scenario:

Caller has elementary school age child. Ex-husband of client, father of child, died intestate several months ago.

Personal Representative is young adult half-sibling of child.

Personal Representative/older sibling lived with dad in the house at time of dad’s death. Sibling continues to reside in dad’s house, is renting rooms to friends, and has now stopped communicating with caller.

Personal Representative has counsel, but counsel also is not communicating with caller.

Caller is very worried that half-sibling has access to dad’s accounts and is spending the money and quite possibly damaging the house and no one will discuss her child’s one-half interest in the estate.

Who’s job is it to ensure a GAL is appointed to protect the minor’s share?

Does caller have standing to intervene and hire counsel for the minor’s interest? Who would the counsel represent?

Thanks in advance for your input -
