Since title isn’t changed as it is effective only on death and can be changed up to that point the issues surrounding what happens when this type of property is transferred is not triggered.

Greetings List -

I have a client who has a 50% ownership in designated forestland (RCW 84.33) and is wanting to establish a TODD. I have reviewed both 84.33 and 64.80 and I am not seeing any prohibition on doing this.

Would love to hear thoughts or cautionary tales. Just because it is a 50/50 ownership with a non-family member and because it is not your regular single family home - just wanted to check the brain trust.
