Dear List Mates,
This is a new one for me. Solvent estate, creditor (credit union) filed and served creditor claim within 4-month period (period ended in April 2020). The claim was for balance owed on a vehicle.
PR (also sole beneficiary) allows claim in a timely manner.
Then, during the summer, PR negotiates with creditor and ends up purchasing the car for a substantially lower amount with agreement from creditor. Creditor tells PR, they will “write off” the debt.
In September, creditor files but does not serve/mail an amended creditor’s claim for the balance. We just found out about the amended creditor claim.
If the claim is not served on PR or PR’s attorney per RCW 11.40.070(3), does the PR have a duty to allow/reject it? Disregard it? Wait out the 24-month period?
Best regards,
Neli
