Is there no formal guardianship for the 23 year old? Seems like the guardian might be able to delegate at least emergency decision making. I am no guardianship lawyer though, and the law is changing drastically effective on January 1 so that's also something to think about.

Not that you asked--but is such a delegation even necessary in this circumstance? They'll just be in Southern California. Same time zone, and plenty of availability via cell phones and Skype or FaceTime or whatever...seems like the friend really shouldn't need much, if any, in loco parentis authority. (You are mentioning medical authority only, so I am assuming the 23 year old is sufficiently capable to dress/feed themselves and understands direction and will be cooperative with the friend.)

Good morning -

I have a client who wishes to take her friend to Disneyland. The friend is 23 and has the capacity of a small child.

I have a parental consent form for getting medical attention for a minor for a trip like this, and wonder if the same for can be used in this situation where the parent signs off and delegates the travel partner to make medical decisions and get care while on vacation.

Any pitfalls that I should be aware of before modifying my current form?
