[WSBAPT] Question about Notice Agents

Hello Learned Listservers,

 

I have a few questions about appointing a Notice Agent in conjunction with
an insolvent estate that has few personal assets.    The beneficiaries would
like to resolve any creditor claims first and then try to fall under the
small estates process without probate given that there is no real property
in the estate and only a old car and bank account as probate assets.  

 

1.	If Creditors do submit their claims within the proper timeframe, are
the beneficiaries obligated to proceed with either opening probate or
proceeding with small estate process and affidavit or can the beneficiaries
abandon the process if the Creditors press their claims against the
decedent?

 

2.	If the creditors properly submit their claims against the decedent
and the beneficiaries abandon the process, are the creditor's claims tolled
or would the two year statute of limitations then apply? 

 

If anyone has a few seconds to help talk me through this, I would certainly
appreciate it.
