Hello Colleagues,

I have been wrestling for some time now on various drafting concepts, one in particular is in the arena of blanket planning for potential special needs trust when the client indicates that no child has special needs. I see some attorneys draft to consider it in every Will (basically, if any beneficiary is receiving benefits then that benes share to SNT), others only address it if there is a known disabled beneficiary. I am curious if some of you would tell me your preferred practice and why - no wrong answer here per se - really I change my mind often when I have the dialogue going on.

What I wonder for those of you who do, do you also t hen draft for potential "what if" scenarios? Drug abuse, in middle of ugly divorce etc. etc.
