I know that Janet Smith and Rebecca King (Northwest Elder Law Group) have been advocating for holding “Family Meeting” as a mediation technique to avoid Guardianship petitions and try to maintain some family unity. https://new.nwelderlaw.com/mediation/
I would suggest reviewing their FAQ’s about Elder Mediation and give them a call, they presented several CLE’s on the subject that were quite good!

I have not.  From my recollection all the mediations I have been involved in are post-petition, but see no reason why mediation would not work perfectly well for that situation too.  As with post-petition mediation, it might be a good idea to put some thought into workable less restrictive alternatives to address the concerns being raised by the would-be petitioners thereby avoiding the petition in the first place.  Saves money too!!

Sangeeta –

            Yes, mediation is used all the time to address and resolve guardianship petitions – and as an ex parte commissioner, Eric Watness is very familiar with the issues and an excellent person to mediate with.  We have also worked with Retired Judge and former Ex Parte commissioner Kim Prochnau who now has her own mediation services and who is also excellent.

Assuming there are issues that might prevent the straight forward dismissal of the petition, one would be well served preparing for mediation by exploring less restrictive alternatives to address the issues raised.
