Sounds like you have competing agendas that can only be resolved by
mediation since there is no presumption in favor of preservation of
timberland to exclusion of value to a joint tenant. Seems like HC needs to
buy the other siblings interest if it is that important to HC and donate it
to one of the conservation groups even if they don’t want to buy it. I know
that is not an answer you would like to present to HC but their position is
untenable as to joint property rights.

Good afternoon,



HC own rural property as joint tenants with right of survivorship with
their sibling. Sibling wants to clear-cut the property; HC won't agree. HC
is afraid that if/when they pass, sibling will clear-cut the property.



HC is unmarried, without children. The estate is modest. The rural property
is small and not of interest to any land trusts. I'm afraid the other
assets in the estate won't be enough to incentivize the sibling from
clear-cutting.



Any other ideas for how to preserve the land?
