Cindy –

            You absolutely want to respond to this petition.  Most likely no later than 12:00 noon four days before the hearing, if noted on a 14 day notice requirement.  You did not say which count this is in, so you need to check the local rules, See King County LCR 98.04.

            It is likely that your client received notice because of the application of 11.28.030.  So – imperative that you respond and appear.

Listmates --

I have a client who received notice of an ex parte hearing on a petition to open a probate. My client is the decedent's spouse and wants to oppose the filer's petition. As I read the ex parte and probate rules, I do not have to file a response before the hearing. Is that correct? I am preparing a response to present at the hearing, but do I file it in advance, too?
