I have been in similar situations and always find it advantageous to file a response with the court ahead of time.  To be safe, I would follow KCLR 98.04(b)(7) and file it by noon, four court days before the hearing.

Listmates --

I have a client who received notice of an ex parte hearing on a petition to open a probate. My client is the decedent's spouse and wants to oppose the filer's petition. As I read the ex parte and probate rules, I do not have to file a response before the hearing. Is that correct? I am preparing a response to present at the hearing, but do I file it in advance, too?
