[WSBAPT] turnover of surplus funds

Hi,

I’m doing a motion for turnover of surplus funds from a foreclosure sale
for the former homeowner.  The HOA has a lien and HUD has a DOT on the
property.  The HOA filed a motion for their money, but HUD hasn’t responded
to either my motion or the HOA’s motion.  If they don’t respond by the time
of the hearing, does that mean they waive their rights to any of the
surplus?  If what remains of the surplus after the HOA is paid is disbursed
to my client, can the HOA come after him later for the amount of their DOT?
