It seems to me that the opposing attorney would fight the dismissal because the attorney  did it correctly and got a judgement against “Jane Doe”.  It is not the plaintiff’s fault that your client is also named Jane Doe.  Also, as I understand it, the judgement constitutes a lien on all real property in the County owed by Jane Doe but not specifically against that property and that Jane Doe.  It seems your fight is with the title company and not with the plaintiff (who may have a legitimate claim against the original Jane Doe) and prove that the your client is not the same Jane Doe as in the lawsuit.

Good Afternoon -

I am helping one of my estate planning clients. She had her property attached as a judgment for a case that was not her. Same name but she does not know the plaintiff, was never served in any case that started in June.  Unfortunately, the Plaintiff's attorney has refused to respond to her calls for over a week and she has asked for my help in intervening.

Thinking a motion to vacate judgment should be straight forward - though I have never done one. Hoping someone may have an example or some authority they would be willing to share.
