[WSBAPT] Estate Exposure - IRS 1095-B Still Lists Ex-spouse as Recipient of Health Coverage

Have you reviewed the dissolution decree?  Might indicate he had to continue coverage for her.
My mom remains on my stepfather’s VA medical insurance after his death and will until she dies.

Dear Listmates,

Decedent-H, veteran from armed forces, divorced since 2003, passed away in March 2016. After expiration of 4-month creditor claim period, PR gets the IRS 1095-B Health Coverage form for 2015 and 2016, listing ex-W as “covered individual,” decedent as “responsible party” and Defense Finance & Accounting Services as “issuer.”

Potential estate exposure for any ex-spouse claims?

Quite possibly, the defense people had no record of the dissolution. The decree of dissolution was faxed to them recently. Not a single document in decedent’s records indicates that Decedent had anything to do with ex-W health insurance after dissolution.

Through numerous calls and a huge runaround, PR still cannot get satisfactory answer whether ex-W ever made any claims against the insurance and whether there is any outstanding balance. The ex-wife denies having done so. Tricare for Life, actual health insurance provider, would not provide any information to the PR.

We are at a point where everything else is done, but we are still concerned not to have a definitive answer on this issue. Tempest in a tea pot?
