Hello, This is a re-post from the solo and small practice listserv - not many replies there. I hope that there might be more advice here.

Client was appointed administrator of sister's estate. Due to questions of solvency, client did not receive non-intervention powers. Client wanted to see about cleaning up the estate and determining solvency. Client has now used letters of administration to contact banks, employers, etc. Although a small payment is to be received from deceased’s employment as realtor, client has determined that the estate is not solvent.

Client has not published notice to creditors. Client does not want to spend more time and money administering the estate. Can she now resign (dismiss the probate) and let the creditors fend for themselves? If so, before she resigns, can she seek payment (from the real estate commission) for her time and the money that she spent in administration? If so, any advice on the process?

As always, thank you for your thoughts.
Rich
