Open a joint probate and that should help you deal with the prior death.  If you need sample, please email me with your work email and I will send to you one I did last year.

Hello listmates,

I have a client who came in for a probate because his dad passed away.  His dad had a will.  I found out that his mother passed away a year earlier.  She had no will, there is no community property agreement, or no documents whatsoever for her.

The property is under both the dad's and the mother's name (not owned with joint right of survivorship).  All the property goes to the son in the dad's will.

Would you recommend doing two probates, one for the mother and one for the father?
