I think it does generally still require a lack of probate affidavit, or something similar, as the TODD conveys title subject to “all conveyances, encumbrances, assignments, contracts, mortgages, liens, and other interests to which the property is subject at the transferor's death, including liens recorded within twenty-four months after the transferor's death under RCW 41.05A.090<http://app.leg.wa.gov/RCW/default.aspx?cite=41.05A.090> and 43.20B.080<http://app.leg.wa.gov/RCW/default.aspx?cite=43.20B.080>.”

So, until notice is published and 4 months passed, the 24 months have run, or an affidavit is filed indicating all debts paid or provided for and no DSHS lien or estate taxes due, it would be a concern for any title company to insure based on the TODD and a death certificate.

I have never used a Transfer on Death Deed.  Does it automatically transfer the property upon death without a Probate or the infamous Lack of Probate Affidavit?
