Lisa,
I have done this before, just state that the Will has already been filed and the cause number in your original paperwork. Stop at the clerk's office before you go to the courtroom and let them know that a Will has already been filed under a different cause number and have them send it to ex-parte. In King County, they will bring it down to ex-parte themselves. The judge/commissioner will appreciate it if you have them do this before you present your case.

No, pretty sure a certified copy won’t work. The original, if it has been filed must be requested from the records window and brought down to ex parte; there doesn’t seem to be a more efficient way to handle it.

I was at ex parte the other day and saw another attorney had the same issue. The commissioner made him go up to the records window to request the will be sent down (or I assume you can purchase a certified copy and present it with the probate matter).

I have included the following language in the petition and otherwise handled it like other petitions:

2.  Will. Decedent died testate, having duly executed her Last Will and Testament, which is dated March 16, 2009, a copy of which is presented herewith. The original of the Decedent’s Will was filed with the court on May 2, 2013, under  cause number ____________. The Decedent was of sound mind and had attained the age of majority when she executed her Will.
