Jared:

I dealt with a case like this a while ago. Take a look at Title 11.80 RCW. Using those provisions we place the funds in a blocked account for the remaining time since the person was last heard from (established by affidavit) and at the end of the total period of absence - which is the affidavit plus the balance of seven years under the statute, had authority to treat the absent beneficiary as having predeceased the decedent and distribute the funds accordingly.

You should be able to handle this as part of the estate administration with minimal cost.

Subject: [WSBAPT] Small Bequest to Lost Heir

Greetings All!

I am representing the PR of an estate with a long-lost beneficiary. The Will leaves a very modest cash bequest to this missing beneficiary. Nobody knows where the beneficiary is, or if he is alive or dead. Any reasonable attempt to locate the beneficiary would likely cost more than the amount of the bequest.
Has anyone dealt with this type of situation before? Any recommendations?
Thanks!

Jared
