[WSBAPT] Will Formalities - clients out of country

Dear Gus:

I have facetimed my clients and walked them through a will signing. You can
also record the will signing to ensure that there is proper execution.

You just need to make sure that you are there electronically to ensure that
the witnesses observe competency.

Good morning,

 

Clients, a married couple, wants to update their current wills. Clients took
a trip overseas and is unsure exactly when they plan to return to
Washington. (The original plan was that the trip would last about a month.)

 

Clients have reviewed the updated wills and have asked if the wills can be
finalized and sent to them (via regular mail or electronically) in order to
allow them to sign the wills and then return the wills to Washington for
safekeeping. 

 

The couple have a number of people around that can serve as witnesses, none
of whom take under the will.

 

My main concern is ensuring compliance with the formalities related to
signing a will. Normally I'd just wait for the client to return but in this
case the return date is unknown and the updated wills make a significant
change to the distribution scheme of the estate.

 

Does anyone have any experience dealing with this type of issue. (This is a
new one for me.)
