Lovie,

Yes - I have had similar dealings with DSHS. DSHS will take 80% of the net estate and the heir(s) will receive 20%.  Make sure you maximize the costs of administration. The PR should take fees and be reimbursed for all costs.  Although income, the fees can help a PR/heir receive a little more from the estate.

Dear listmates,

Has anyone worked with DSHS to settle a creditor's claim that renders the estate insolvent? I contacted DSHS early on and the revenue agent indicated that sometimes DSHS will reduce the claim to allow the heirs to keep about 20% of the residual estate. Has that been your experience in similar situations? Thanks in advance for your help.
