[WSBAPT] guardianship referral

Hi Listmates,

I am looking for someone willing to talk with a PC about petitioning the court to appoint a professional guardian of the person and estate of a woman who suffers what I understand to be severe mental illness and dysfunction. The petitioner would be the woman’s aunt, but she doesn’t want to serve as guardian. My understanding is that the AIP has little money, and has refused efforts by mental health professionals to assist her with such things as applying for social security benefits of her deceased husband. These benefits would keep her housed, yet she refuses. Without it, she may become homeless in about three months time. The financial constraints make it difficult to refer. I have never done a guardianship petition, so I don’t exactly feel competent, plus I have what is probably a conflict of interest. (The mental health provider of the AIP’s 17 y.o. daughter is my relative). It is possible that guardianship isn’t actually the right arena--?

I would appreciate any suggestions or attorneys willing to talk to the possible petitioner or the mental health provider. The daughter is in crisis over the situation and has been the only reason the mother is surviving, but it is more than she can continue to bear.

thank you,
