[WSBAPT] Emergency Room Records

Hi Tom,

The problem here is that the records are not client's.  They are records of
one of his residents who is no longer at the home and the POA is not going
to agree to signing the release.  My understanding is that in order to
subpoena records there needs to be a active litigation to get a court order.
So in the absence of litigation or POA consent, is there any other way of
getting these records.

I use an Authorization for Health Care Disclosure when my client is able to
sign the document.
