Lisa,

 

In addition to your concern about the AIF getting paid a reasonable
compensation, make sure to include language in both DPOAs (medical and
assets) that assures the AIF with the health care power that the AIF
with the financial power has an obligation to pay for the health care
decisions of the health care AIF. Put another way, the health care AIF
can bind the financial AIF to pay for the health care decisions.

My client is nominating a professional guardian as financial AIF (they
have a service agreement).  She may also have a different professional
as health care AIF.  I think the POA should state that they are entitled
to be paid and I'm looking for suggestions on how to handle that.
