Dear Listmates,

I have a case where the Estate is likely going to escheat to the State of Washington. The Decedent passed away intestate, and Decedent's friend was appointed as PR with nonintervention powers. At the outset of the probate, it was believed that the Decedent had distant relatives that met the requirements of an heir under RCW 11.04.015; however, after an heir search company has retained, it was determined that the cousins were too far removed to take under Washington State Intestate Succession. I immediately contacted the Washington State Department of Revenue, who gave consent to hire another heir search company to confirm that there were no heirs of the Decedent. At this point, I have two Declarations from investigators confirming that the Decedent passed away without heirs.

I intend to seek an "alternative decree" under RCW 11.68.100(1)(a), requesting the court to "find and adjudge the heirs of the decedent". However, as I've never proceeded under RCW 11.68.100, I was hoping for some insight from anyone who may have had a similar situation in the past.

I appreciate your assistance.

Best regards,

Miriam Ayoub
