Steve,  I have petitioned (recently here in SJC as well as in KC many years ago) for authority to open a box as attorney for the purported PR nominated in will.

Hi all,

 

Is there any authority for a court to order a safe deposit box opened to look for a will without appointment of a special administrator in those counties that do not have a local rule addressing this situation?

 

I assume that a petitioner who asks for appointment of a special administrator is a “party” and cannot be appointed.  Is this incorrect?
