If the decedent died without a will, and a beneficiary is receiving some sort of means tested government benefits, such as SSI, you can create a Grantor Trust (what’s called a D4A Trust because that the Ref. regulation), and DSHS must be named as a remainder beneficiary up to the amount of any Medicaid costs it has expended on the beneficiary.  You would have to have a court-created SNT only if the Grantor (Beneficiary) is an incapacitated person without a guardian.
