Mountain Park Homeowners Assn., Inc. v. Tydings, 125 Wash.2d 337, has a good

Subject: [WSBAPT] Waiver of enforcement of protective covenants

List mates I'd appreciate any citations involving case where the issue was
enforcement of protective covenants in a subdivision due to the allegations
that the HOA and/or the homeowners had failed to uniformly enforce the
covenants for example there was construction over a number of years on
certain lots of multifamily structures which were restricted to single
family detached structures by the covenants and now the HOA is objecting to
multifamily construction on such lots even though over the years the zoning
was changed to permit it.
