Ann provided me with a copy of the text of a notice that she sent out to another listserve that provides insight into the scope of the lawsuit:


"As you may be aware, Premera Blue Cross got hacked last May, and 11 million members' records were compromised. The company has only just now admitted to the hack. I have a client in NY who is working with another firm to file a class action on behalf of Premera members and she's looking for WA insureds. If you are interested in lending your name to this, please let me know.

Also, I'm wondering if you have children insured by Premera. Children are even more vulnerable than adults because problems usually don't show up for them until many years down the road when they apply for credit, or even file for social security. If someone else is using your child's identify and social security number to receive medical services, this can come back to get your child when he/she is taken to the hospital for emergency treatment after an accident in a school baseball game. The child's on-line health information may show that he/she is, say, Type A blood, so that's the transfusion your Type O child will receive. Providing free credit report checking for a year or two isn't enough.

Colleagues, any thoughts on how (or if) the breach of Premera medical records should be handled or to whom clients can be directed?

A client received notice that her minor child’s records may have been breached. She is wondering if she needs to talk with a lawyer about it.
