[WSBAPT] Probate vs. Lack of Probate Affadavit

List mates,

My client came in and asked me to draft a will.  His wife died last year.
Her will left everything to my client (her husband).  There was no probate
done.  The couple own a house that is in both of their names.  They own it
as tenants in common.  There is no community property agreement.  Would it
be better to open a probate or try to enter a Lack of Probate Affidavit to
get the property into the husband's name?
