I also agree with Eric. I have acted as a court appointed referee in a
number of these and have been able to get a court order allowing me to act
as a private seller avoiding the auction scenario which never brings full

Dirt types,

 

Could you possibly give me an estimate re what a partition action may
cost?  

 

Facts:  House was in RLT.  Both trustors are now deceased, the survivor
spouse having died in January 2013.  Former counsel had trustee transfer
house out of trust and into names of the two beneficiaries, children of
trustors, as tenants-in-common.  One sibling (client) is out of state.
Other sibling, although he has a house of his own, has moved in himself,
his incredibly sloppy habits, and a revolving menagerie of people and
animals.  He has put in a custom entertainment center to house his large
TV and has purchased an extended cable package.  Two real estate agents
have told client the house should sell for 1.1 to 1.2 million.  Hopefully
client can implore her brother to list the house with an agent and leave
voluntarily, but if not . . .
