Josh, 

 

I agree with Jane. Sue on the Note, obtain a Judgment against heir, wait
10 days, get your Writ of Garnishment issued with Estate named as
Garnishee Defendant and garnish the Estate like it’s a bank.

Wouldn’t you have to sue on the Note and obtain a judgment that could be
filed against the maker’s share of the estate?

I have a client who holds a promissory note.  The maker is one of the
children of a recent decedent whose estate has just started.  Maker is
going to inherit 1/4th of the estate.

 

Anyone have any suggestions in garnishing the PR to have the debt paid?
