[WSBAPT] Stocks and mutural funds going into living trust?

Hi All, 

 

Client husband and wife have a revocable living trust and are wanting to
know what types of financial accounts should and shouldn’t be placed in
the trust at this time.  I know they cannot/should not place IRAs, 401K’s
and similar types of retirement accounts into the trust, since that can be
treated as an early disbursement of funds by the IRA, thus leading to
penalties.  However, what about mutual funds and stocks that are simply
owned by the clients individually or as husband and wife.  These are
intended as investments for retirement, but not necessarily, and they are
not held in an IRA or 401K.  Is it ok to place those in the trust now?  Or
should the clients leave them out of the trust and just make the trust the
beneficiary of those funds?

 

I am just looking for a quick answer to tell the clients and I am short on
time today to research it; I have also referred them to a CPA who handles
estate issues.
