[WSBAPT] Trustee instructions in separate letter

Hi All,

I am trying to grapple with the legality of a separate letter to a trustee
that is outside the trust document.  The trust refers to the letter of
instruction and incorporates any such letter, but it has an interesting
statement that if the state law does not allow such a document to be
incorporated then it is advisory.  After attempting to research if WA
allows such a writing outside of the trust I am unable to find something
that gives me some specific direction.  Has anyone researched such an
issue before to see if the letter is binding or only advisory?  Any
direction is greatly appreciated!
