Roger,

States don't have authority to deny equal liberty per the Constitution. States do don't have the authority to deny equal rights per the Constitution.

The is why the federal government is involved in striking down the unconstitutional marriage bans. If the states were enforcing their laws uniformly, the Feds wouldn't need to be involved.
