Here's another example of where Tom doesn't have Constitution First Amendment protection:

Tom, mistakenly thinking that 'the first amendment legally permits [him] to go into the Backdoor (a bar in south central Los Angeles) and say, "Fu*k you, nig*r!', does just this.  The patrons ask management that Tom be asked to leave or else forcefully removed.  Tom is bounced out and shortly thereafter returns still mistakenly thinking that 'the first amendment legally permits [him] to' repeat his actions.  Management calls police and they forcibly remove Tom from the premises.  Shortly thereafter, Tom returns still mistakenly thinking that 'the first amendment legally permits [him] to' repeat his actions. Management once again summons police and they arrest him and haul him away to post process him down at the precinct.

What happened to Tom's Constitutionally guaranteed right to free speech?  Tom thought that the first amendment legally permitted him to go into the Backdoor (a bar in south central Los Angeles) and say, "Fu*k you, nig*r!''.  He was mistaken.  He'll never admit this.
