Bustamante records to be released today
University of Idaho President Duane Nellis will discuss with media representatives at 1 p.m. today the release of personnel records related to former assistant professor Ernesto Bustamante, who killed graduate student Katy Benoit in August, which is expected today.
Bustamante shot Benoit 11 times in the neck and chest with a .45-caliber handgun as she was smoking a cigarette on the back porch of her Moscow home Aug. 22 before hours later killing himself in a Moscow hotel room following a standoff with law enforcement. Benoit had filed a complaint against Bustamante in July following a sexual relationship that deteriorated when he threatened her life on three separate occasions, and the former psychology professor’s employment at the UI ended Aug. 19.
TPC Holdings, Inc. — Moscow-Pullman Daily News and Lewiston Tribune — and other media outlets represented by First Amendment attorney Chuck Brown argued the release of Bustamante’s employment records before Latah County 2nd District Judge John R. Stegner following an action for declaratory relief filed by the UI in late August. Stegner approved of the records being released, stating personnel information of the deceased is not protected under Idaho Code.
UI Counsel Kent Nelson is expected to meet with Brown early today to discuss release of the records, but information gathered by the Daily News from collaborating media agencies indicates the records will be delivered via FedEx in varying intervals to news outlets.
The Daily News’ management plans to hold a correspondence with its partnering agencies to develop a method for maximizing efficacy in review of the records and story production for our readership. As news develops, so will the stories that will be provided.
