It not quite as simple as "Newsweek used the photo without permission."

Since Crabtree thinks that the cover photo of Palin is sexist, perhaps he'll also claim these photos of a familiar political figure in shorts is sexist also.

No one is seeking any type of recourse to my knowlege. (Runner's World possibly excepted) My assertion that Newsweek used the photo without permission was questioned and I was simply backing up my remark.

I don't think Palin has much recourse considering that she willingly posed for the photo and is a public figure. If she was a private person, or was not posing for the photo, she could probably sue. But I don't think she will get anywhere with this other than complaining. She also would have to show actual harm caused her by the photo, and I don't think anyone is thinking it is a bad photo, in fact, she looks rather healthy and athletic, especially for a grandmother. :)

Regarding copyright, Newsweek may very well have purchased, or may have been granted permission by the publisher of Runner's World, or the photographer to use the photo.
In addition, Palin may have signed a release allowing Runner's World or the photographer to do basically whatever they wanted with the photo, including selling it to other organizations.
Even if she didn't sign one, they could have bypassed any need for Palin's approval since it was used in an editorial context.
Just because Palin is the subject of the photo doesn't mean she has any rights to it's use, that right belongs with the owner of the copyright.
If there was any infringement, that issue would be between Newsweek and the copyright owner. Palin would have nothing to do with it.
