<DIV>I don't think Palin has much recourse considering that she
willingly posed for the photo and is a public figure. If she was a
private person, or was not posing for the photo, she could probably
sue. But I don't think she will get anywhere with this other than
complaining. She also would have to show actual harm caused her by the
photo, and I don't think anyone is thinking it is a bad photo, in
fact, she looks rather healthy and athletic, especially for a
grandmother. :)</DIV>

very well have purchased, or may have been granted permission by
the publisher of Runner's World, or the photographer to use the
photo.</FONT></DIV>

a release allowing Runner's World or the photographer to do
basically whatever they wanted with the photo, including selling
it to other organizations. </FONT></DIV>

could have bypassed any need for Palin's approval
since it was used in an editorial context.</FONT></DIV>
<DIV><FONT size=2 face=Arial>Just because Palin is the subject
of the photo doesn't mean she has any rights to it's use, that
right belongs with the owner of the copyright.</FONT></DIV>
<DIV><FONT size=2 face=Arial>If there was any infringement, that
issue would be between Newsweek and the copyright owner. Palin
would have nothing to do with it.</FONT></DIV>
