[Vision2020] Copyright-was "The new The Saga Continues"

I don't think Palin has much recourse considering that she willingly posed for the photo and is a public figure. If she was a private person, or was not posing for the photo, she could probably sue. But I don't think she will get anywhere with this other than complaining. She also would have to show actual harm caused her by the photo, and I don't think anyone is thinking it is a bad photo, in fact, she looks rather healthy and athletic, especially for a grandmother. :)

Sounds like a lawsuit in the making to me. Someone at that stock agency will probably be joining the line at the unemployment office as well.

"On the cover of this week's issue of Newsweek is a photo that was shot exclusively for the August 2009 issue of Runner's World, in which Sarah Palin was featured on the monthly "I'm a runner" back page. The photos from that shoot are still under a one year embargo, and Runners World did not provide Newsweek with its cover image. It was provided to Newsweek by the photographer's stock agency, without Runner's World's knowledge or permission."

Regarding copyright, Newsweek may very well have purchased, or may have been granted permission by the publisher of Runner's World, or the photographer to use the photo.
In addition, Palin may have signed a release allowing Runner's World or the photographer to do basically whatever they wanted with the photo, including selling it to other organizations.
Even if she didn't sign one, they could have bypassed any need for Palin's approval since it was used in an editorial context.
Just because Palin is the subject of the photo doesn't mean she has any rights to it's use, that right belongs with the owner of the copyright.
If there was any infringement, that issue would be between Newsweek and the copyright owner. Palin would have nothing to do with it.
